The new rules enacted on behalf of all California workers require employees to file a Workers' Compensation claim form with their employer if they have been infected with Covid-19.
Most importantly, by filing a Workers' Compensation Claim, you are ensuring possible coverage for any underling or long-term medical complications due to a COVID-19 infection.
We are here for you. Call us at 951-244-1776 for a Free Consultation.
In addition to being here for your Workers’ Compensation and Social Security Disability claim needs, we also wanted to provide some information that might help you during these trying times.
Here are some options:
File for UNEMPLOYMENT if you have recently lost your job or had your hours reduced. You can file online at edd.ca.gov. The maximum weekly benefit rate is $490 and it is taxable. If your unemployment is due to Covid-19 you could get an additional $600 a week through the end of July. The amount and length of time could change based on the proposed federal stimulus package. Be sure to mention your employment was impacted by Covid-19.
File for STATE DISABILITY if you have a physical or mental condition that prevents you from working. You can file at edd.ca.gov. The maximum weekly benefit rate is $1252 and it is not taxable. It can last up to 12 months.
File for WORKERS' COMPENSATION benefits if you have a physical or mental condition caused or aggravated by your employment. You can file even if you have been laid off or fired. The cause or aggravation can be due to a specific incident at work or due to repetitive or cumulative trauma at work. It covers orthopedic conditions like back problems, carpal tunnel, plantar fasciitis, etc. Workers's Compensation also covers internal issues like exposure to COVID-19 at work, blood pressure issues, heart issues, cancer, etc. In addition to a non-taxable weekly benefit rate of up to $1299.43 you may also be eligible for medical care, school retraining and a disability award. Call us now for a free no obligation consultation. What you put on the initial paperwork is extremely important in helping determine if you will receive benefits. We offer a free consultation with a no recovery - no fee guarantee. Call us today at 951-244-1776.
File a WORKERS' COMPENSATION DEATH claim if the worker’s condition causing death was related to any degree to his or her employment. The maximum potential benefit is $320,000. Call us for a Free no obligation consultation at 951-244-1776.
File for SOCIAL SECURITY RETIREMENT. Before filing for Social Security retirement consider filing for unemployment or state disability or a Worker’s Compensation claim. Usually, the longer you wait to collect Social Security retirement the higher the monthly rate will be.
File for SOCIAL SECURITY DISABILITY. However, due to the five month waiting period and the up to two year delay in having your case heard if you were not immediately approved you should consider also filing for state disability and Worker’s Compensation benefits.
Are you a Union Worker? Take a moment to contact your union representative so you can maximize any leave benefits you may need.
You or someone you know may need assistance to get through this. We are here. Call anytime - even this weekend at 951-244-1776.
Our firm utilizes a secure online Case Management Software, which allows our team to easily access and efficiently manage your case file anywhere. This paperless program also allows us to track email communications, which is the best way to communicate with our office as it also tracks any issues that may need monitoring as it relates to your case.
In addition, most adjusters can only be reached by email now and a lot of them work remotely so there shouldn't be much of an interruption with contacting them. Our office also has a lot of the cell numbers (and emails) for the defense attorneys we work with so we can continue to communicate with them directly.
We expect some Workers' Compensation Appeals Boards may likely shut down for in person live hearings for a while. Our office is already signed up to appear for hearings by phone and video. We may arrange to have you appear that way too, if needed. Courts are arranging to have Judges available by phone or video to conduct hearings, however, with the rapidly changing guidelines to prevent the spread of the virus we may see some delays due to these new arrangements.
The courts have also gone to a paperless computer based program, which means we can now submit documents to the court remotely and can contact the Judge about your case under some circumstances remotely (with the other side also present) and that may also become necessary for a while.
We understand the benefits of health and mental well-being and will continue to work on your behalf through these troubling times.
Guidelines for social distancing to slow the spread of the Covid-19 Cornonavirus may require some changes to your medical or other appointments.
If you have concerns about attending an upcoming doctor's appointment, please contact the doctor's office directly to see if they have the ability to host a phone appointment and to also have your disability possibly extended.
Please call our office at 951-244-1776 and email our office if you have any concerns regarding attending an upcoming PQME or AME medical legal appointment.
Email our office and let us know if you need to reschedule any other appointments or are having any issues receiving medicine or anything else related to your case. The more details you provide in your email will help us better help you.
